Terms of Service

The ground rules for a good roast.

What Roast & Toast is

Roast & Toast lets an organizer collect short video stories from friends, family, and coworkers for someone they care about, arrange them, and share them with that person. Stories play one after another in the order the organizer chooses. We don’t edit, render, or export a movie.

We’re a small company and we’ll keep improving the service. Features may change, and we may add, change, or remove parts of it. If a change takes away something you paid for, we’ll make it right as described under Payments.

Who can use it

  • You must be at least 13 years old to add a story or watch a gift, and at least 18 to create an organizer account or make a purchase. If you’re under 18, add a story only with a parent or guardian’s okay.
  • If you’re using Roast & Toast on behalf of a company or group, you confirm you’re allowed to accept these terms for it.
  • You can’t use the service if the law where you live prohibits it, or if we’ve previously suspended you.

Organizer accounts

Organizers sign in with an email address and password, or with Apple or Google where offered. Keep your sign-in details to yourself and tell us at support@roastandtoast.app if you think someone else has used your account. You’re responsible for what happens in your account. Contributors and recipients don’t need an account.

Your stories and videos

You keep ownership. Videos, names, messages, and other material you add (“your content”) stay yours.

You give us permission to run the service. You grant Roast and Toast, LLC a worldwide, non-exclusive, royalty-free license to store, copy, process, transcode, and display your content only as needed to provide the service: for example, to show a story to the gift’s organizer, play it in the reveal, and show it to the recipient through their private link. This license ends when your content is deleted, except for copies in routine backups that expire on their own schedule, as described in our Privacy Policy. We don’t sell your content, use it in advertising, or use it to train AI.

Videos saved before you send. On the newer invitation page your videos are saved privately while you record. The organizer can’t see them until you press Send, and unsent videos are deleted on the schedule in our Privacy Policy.

Sharing a story with an organizer. When you add a story, you’re giving it to that gift’s organizer, who decides whether to include it and who to show the finished gift to. The organizer may play it for the recipient and others celebrating with them.

You confirm you have the right to share it. By adding content, you confirm that you made it or have permission to use it, that everyone who can be identified in it agreed to be included, and that sharing it doesn’t break any law or anyone else’s rights, including copyright, privacy, and publicity rights. Background music you don’t have rights to can be a problem; when in doubt, leave it out.

Keep it a roast, not a takedown

A good roast is affectionate. Teasing is welcome; cruelty isn’t. Don’t use Roast & Toast to:

  • harass, threaten, bully, or demean anyone, or target people based on race, ethnicity, religion, disability, sex, sexual orientation, gender identity, or similar characteristics;
  • share sexually explicit content, or any sexual content involving a minor;
  • share someone’s private information, intimate images, or recordings they didn’t agree to;
  • share violent, illegal, or dangerous content, or encourage self-harm;
  • impersonate someone, or mislead people about who you are;
  • send spam, or text people who haven’t agreed to hear from you;
  • upload malware, probe or break our security, scrape the service, overload it, or get around its limits; or
  • use the service for any unlawful purpose.

Videos of children should only be added with the permission of their parent or guardian, and by adding one you confirm you have it. If you see something that breaks these rules, email support@roastandtoast.app. We may remove content or suspend access that we reasonably believe breaks these terms or puts people at risk, but we don’t review every story, and organizers control what goes into their gift.

What organizers are responsible for

  • Inviting people fairly. Only invite people you know and believe would want to take part. When you invite someone by text from the app, the message is sent from your own phone’s Messages app, and you confirm that you have their number lawfully and that they’d expect to hear from you about the gift. Don’t text anyone who has asked you to stop.
  • Choosing what to share. You decide which stories go into the gift and who receives it. Please respect a contributor’s request to remove their story.
  • Keeping a copy of anything irreplaceable. We work hard to keep stories safe, but the service isn’t an archive. Keep your own copies of videos that matter to you.

Payments

  • What’s free. Creating a gift, inviting people, collecting stories, previewing each story, and arranging the reveal are free. Contributors and recipients never pay.
  • What you buy. A one-time purchase for a single gift unlocks its complete arranged reveal and private recipient sharing. The price and any tax are shown before you pay. It isn’t a subscription and doesn’t unlock other gifts.
  • Who processes it. Purchases in the iPhone app are made through Apple’s in-app purchase and handled by Apple under Apple’s terms. Purchases on our website are processed by Stripe, which may act as the seller of record and handle tax, receipts, and payment support under its own terms. We never see or store your full card number.
  • Refunds. If something went wrong with a purchase, such as a duplicate charge or a gift you couldn’t reveal or share because of a problem on our side, email support@roastandtoast.app and we’ll make it right, including a refund where appropriate. App Store purchases are refunded through Apple. A refund doesn’t delete the gift.
  • Prices can change. A price change never affects a gift you’ve already unlocked.

Apple, Stripe, and other services

Roast & Toast relies on other companies, such as Apple, Stripe, Supabase, and Vercel, to run. Their own terms apply when you use their services, and we aren’t responsible for their products.

If you downloaded the iPhone app from Apple’s App Store, these terms are between you and Roast and Toast, LLC, not Apple. Apple isn’t responsible for the app, its content, maintenance, support, or any claims about it. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app, if any; to the maximum extent the law allows, Apple has no other warranty obligation. Apple isn’t responsible for investigating or defending any claim that the app infringes someone’s intellectual property rights, or for claims about product liability, legal compliance, or consumer protection; those are our responsibility. You must also follow any third-party terms that apply when you use the app, such as your wireless carrier’s. Questions, complaints, or claims about the app can be sent to us at support@roastandtoast.app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you aren’t located in a country subject to a U.S. government embargo and aren’t on any U.S. government list of prohibited or restricted parties.

Deleting, suspending, and ending

You can stop using Roast & Toast at any time. Organizers can delete stories, gifts, and their account in the app; contributors can remove their own story as described in the Privacy Policy. We may suspend or end your access if you seriously or repeatedly break these terms, if the law requires it, or to protect people or the service. Where it’s reasonable, we’ll tell you first and give you a chance to save your content. If we ever shut down the service, we’ll give organizers at least 30 days’ notice first. The sections on your content’s license (for copies that remain), disclaimers, limits on liability, indemnity, and governing law continue to apply after your use ends.

Disclaimers

We work hard to make Roast & Toast reliable, but the service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, and we don’t promise that the service will be uninterrupted, error-free, or that content will never be lost. We don’t control what contributors say in their stories and aren’t responsible for it. Some places don’t allow these disclaimers, so they may not all apply to you.

Limits on liability

To the fullest extent the law allows, Roast and Toast, LLC and its members, employees, and agents won’t be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost goodwill, arising from or relating to the service or these terms. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim arose or US $50. These limits apply whatever the legal theory and even if we were told the damage was possible. Nothing in these terms limits liability that can’t be limited by law.

Indemnity

If someone brings a claim against us because of content you added or your breach of these terms, you agree to cover our reasonable costs of that claim, including reasonable attorneys’ fees, to the extent the law allows.

Governing law and disputes

These terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. If you have a concern, please email us first; most problems can be sorted out quickly. If we can’t resolve it within 30 days, either of us may bring a claim in the state or federal courts located in Utah, and we both consent to their jurisdiction. Either of us may instead bring an individual claim in small-claims court where it qualifies. If you’re a consumer, you keep any rights the law where you live gives you that can’t be waived by contract.

Changes and general terms

We may update these terms as the service changes. If a change is significant, we’ll tell organizers by email or in the app before it takes effect and update the date at the top. Continuing to use the service after a change takes effect means you accept it.

These terms, together with our Privacy Policy, are the whole agreement between you and us about the service. If any part is found unenforceable, the rest stays in effect. If we don’t enforce a term right away, we haven’t given up the right to enforce it later. You can’t transfer these terms without our permission; we may transfer them as part of a merger, acquisition, or sale of the service.
